AN ASSESSMENT OF COMPULSORY ACQUISITION PRACTICE (A CASE STUDY OF FEDERAL POLYTECHNIC, UKANA.)

ABSTRACT

This research was carried out to assess compulsory acquisition practices in Nigeria using Federal Polytechnic, Ukana in Essien Udim Local Government Area of Akwa Ibom State as a case study. The objectives were: to find out how affected people are usually notified of Government’s intention to compulsorily acquire their interests in land, to investigate who carries out compensation assessment, to find out the adequacy or otherwise of the compensation paid, to find out the problems associated with compensation payment and to find out how such problems could be resolved. Both primary and secondary sources of data collection were employed. Literature was reviewed to aid the direction of the study. A total of 34 copies of well-structured questionnaire which represented a 5% sampling size of a population of 694 were administered, out of which 32 copies were correctly filled and returned for analyses and interpretation. The study revealed among other things that, the acquiring authorities always refuse to use proper means and channel to communicate to the affected property owners, and that a long period of time often elapses between when a property is valued for compensation and when the compensation for it is eventually paid. The study recommends amending the Land Use Act and the radical harmonization of all conflicting laws on compulsory purchase.
