GENERAL INTRODUCTION

1.1       Background of the Study

Under Nigerian law, military personnel are subject to two laws: Nigerian military law and Nigerian civil law. Therefore, from this point of view, the management of the property of the deceased military personnel is considered. In general, real estate management involves the realization of movables and the settlement of debt and other claims against real estate. It also deals with the division and distribution of what remains 1. Conversely, this study deals with the will of military personnel who died under Nigerian military law and the division and distribution of property. Army Law 2 is currently the main law governing the Nigerian army..

Under civil law, the laws governing the management of the property of the deceased in Nigeria vary from state to state, and the applicable law depends on whether the state in the area in question currently has its own will and property management law. .. Despite these developments, some states now have their own legislation, but most states in Nigeria still apply pre-1900 English law with minor amendments.
